Terms of Service

ViralSpy is a software-as-a-service tool that tracks public Instagram and TikTok accounts you choose, detects videos whose views are spiking, analyses video hooks using artificial intelligence, and sends alerts (for example via Telegram). Features, limits and supported platforms are described on our website and may change over time.

• You must be at least 18 years old and able to form a binding contract to use ViralSpy.
• If you use ViralSpy for a business, you confirm you are authorised to accept these Terms on its behalf.
• You must give accurate information and keep your login details secure. You are responsible for all activity on your account.
• Tell us promptly at bizxronyo@gmail.com if you suspect unauthorised use of your account.

• Paid plans start with a free 14-day trial. A payment card is required to start it. If you cancel before the trial ends, you are not charged.
• If you do not cancel, your subscription starts automatically when the trial ends and your payment method is charged the plan fee, then again at the start of each billing period, until you cancel.
• Payments are processed by Dodo Payments, which acts as merchant of record and reseller of the service. Your purchase is also subject to Dodo Payments' buyer terms.
• You can cancel anytime from the Billing page in your account. After cancelling, you keep access until the end of the period you have paid for.
• Payments are non-refundable except as described in our Refund & Cancellation Policy.
• We may change prices or plan limits. Price changes for existing subscriptions take effect from your next billing period after we give you notice, and you can cancel before then.
• If a payment fails, we may suspend or downgrade paid features until payment succeeds.

You agree not to:

• use ViralSpy for anything unlawful, or to harass, stalk, threaten, defame or harm any person;
• use information obtained through ViralSpy to copy or re-upload other creators' content in a way that infringes their copyright or other rights;
• use ViralSpy to collect data about individuals for purposes unrelated to content and competitor research, or to build profiles of private individuals;
• resell, sublicense or share your account, or provide ViralSpy to others as a service, without our written permission;
• scrape, copy, reverse engineer or attempt to access ViralSpy's source code, systems or data other than through the normal interface;
• get around plan limits, security measures or rate limits, or create multiple accounts to obtain extra free trials; or
• interfere with or overload the service, or upload malware.

You are responsible for how you use the insights, analyses and data you get from ViralSpy, and for complying with the terms of Instagram, TikTok and any other platform you use.

ViralSpy relies on publicly available data from Instagram and TikTok and on third-party services such as Telegram, Google and Dodo Payments. We are not affiliated with, endorsed by or sponsored by Instagram, Meta, TikTok, ByteDance, Telegram or Google. These platforms may change or restrict access to their data at any time, which may affect or interrupt some features. We are not responsible for third-party platforms or their content.

You keep ownership of the information you submit (such as the accounts you track and links you paste). You give us permission to use it only to provide and improve the service.

ViralSpy, including its software, design, branding and the analyses and reports it generates, is owned by us and protected by law. We give you a personal, non-exclusive, non-transferable right to use ViralSpy and the analyses it produces for your own business or creative purposes while your account is in good standing. Content posted by creators on Instagram and TikTok belongs to those creators.

Hook scores, hook types, explanations and viral alerts are generated automatically using engagement data and artificial intelligence. They are for information only and may be incomplete, delayed or inaccurate. We do not guarantee any results, including that your content will go viral, gain views, followers or revenue, or that every spike on a tracked account will be detected or alerted.

We work to keep ViralSpy running around the clock, but the service is provided on an "as is" and "as available" basis. It may be interrupted for maintenance, updates, third-party outages or reasons outside our control. We may add, change or remove features, and will give reasonable notice of changes that materially reduce what your paid plan includes.

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, followers or business opportunities, arising from your use of or inability to use ViralSpy. Our total liability for any claim relating to ViralSpy is limited to the amount you paid us in the three (3) months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

You agree to compensate and hold us harmless from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of ViralSpy or of data obtained through it.

You can stop using ViralSpy and ask us to delete your account at any time. We may suspend or close your account, with notice where reasonably possible, if you breach these Terms, fail to pay, abuse free trials, create risk or legal exposure for us or others, or if required by law. If we close your account without cause, we will refund any prepaid fees for the unused part of your billing period. Sections that by their nature should survive termination (including 6, 7, 9, 10 and 13) will continue to apply.

We may update these Terms from time to time. We will change the "Last updated" date, and for significant changes we will notify you by email or in the app before they take effect. If you continue using ViralSpy after changes take effect, you accept the updated Terms. If you do not agree, you can cancel your subscription.

These Terms are governed by the laws of India. Please contact us first so we can try to resolve any dispute informally. Subject to that, and to any rights you have under consumer protection laws where you live, the courts at Khargone, Madhya Pradesh, India will have exclusive jurisdiction.

In accordance with the Information Technology Act, 2000, the Consumer Protection Act, 2019 and the rules made under them, our Grievance Officer is:
